Terms of Service

1. Acceptance of Terms

By accessing and using StampSwap ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Platform Description

StampSwap is a marketplace platform that connects buyers and sellers of NFA-regulated items including suppressors, Short Barreled Rifles (SBRs), Short Barreled Shotguns (SBSs), and Any Other Weapons (AOWs). StampSwap is NOT a Federal Firearms Licensee (FFL), does not take possession of any NFA items, does not process payments for NFA transactions, and does not facilitate or approve ATF Form 4 transfers.

3. User Eligibility

You must meet ALL of the following requirements to use StampSwap:

  • Be at least 18 years of age
  • Not be a prohibited person under federal law (18 U.S.C. § 922(g))
  • Be a legal resident of the United States
  • Reside in a state where the NFA items you wish to buy or sell are legal

4. User Responsibilities

Users are solely responsible for ensuring all transactions comply with federal, state, and local laws. This includes but is not limited to: completing ATF Form 4 transfers, conducting background checks, providing required documentation, and verifying the legal status of all parties involved.

5. Listing Accuracy

Sellers must provide accurate information in their listings, including item type, manufacturer, model, condition, and serial number. Misrepresenting items is prohibited and may result in account suspension.

6. Prohibited Items

The following items may NOT be listed on StampSwap:

  • Machine guns
  • Destructive devices
  • Items not registered in the National Firearms Registration and Transfer Record (NFRTR)
  • Solvent traps marketed as suppressors
  • Items illegal under federal law
  • Items from states where the specific item type is prohibited

7. Payments

StampSwap does not process payments for NFA item transactions between users. Platform service fees (listing bumps, featured listings, subscriptions) are processed through Stripe and are subject to Stripe's terms of service.

8. Limitation of Liability

StampSwap provides tools and information for reference purposes only. We are not responsible for the accuracy of state compliance data, Form 4 guidance, or any information provided on the Platform. Users should verify all information with qualified legal professionals.

9. Account Termination

StampSwap reserves the right to suspend or terminate user accounts that violate these Terms of Service, including but not limited to listing prohibited items, engaging in fraudulent activity, or harassing other users.
