Legality Summary
Understanding NFA State Laws
Federal vs. State Law
NFA items are regulated at both the federal and state level. Even though federal law permits the ownership of suppressors, SBRs, SBSs, and AOWs, individual states can impose additional restrictions or outright bans. You must comply with both federal and state law.
Local Restrictions
Even in states where NFA items are legal, some cities and counties may have additional local ordinances restricting possession or use. Always check your local municipality regulations in addition to state law.
ATF Form 4 Required
Regardless of state law, all NFA item transfers between individuals require ATF Form 4 approval, including a background check, fingerprints, passport photo, and CLEO notification. The tax stamp is now $0 as of January 2026.
States Where Suppressors Are Prohibited
Suppressors are legal in 40 of 51 states. The following states prohibit civilian suppressor ownership:
