Understanding NFA State Laws

Federal vs. State Law

NFA items are regulated at both the federal and state level. Even though federal law permits the ownership of suppressors, SBRs, SBSs, and AOWs, individual states can impose additional restrictions or outright bans. You must comply with both federal and state law.

Local Restrictions

Even in states where NFA items are legal, some cities and counties may have additional local ordinances restricting possession or use. Always check your local municipality regulations in addition to state law.

ATF Form 4 Required

Regardless of state law, all NFA item transfers between individuals require ATF Form 4 approval, including a background check, fingerprints, passport photo, and CLEO notification. The tax stamp is now $0 as of January 2026.

States Where Suppressors Are Prohibited

Suppressors are legal in 40 of 51 states. The following states prohibit civilian suppressor ownership:

If you live in one of these states, suppressor ownership is prohibited under current state law. Laws can change — check your state legislature for pending legislation.

Find used suppressors, SBRs, SBSs, and AOWs from private sellers. Save 30-50% vs. buying new from a dealer.

Disclaimer: StampSwap does not provide legal advice. State compliance information is for reference only and may not reflect the most current laws. Some states have additional local restrictions that are not captured here. Consult a qualified attorney or your local FFL/SOT dealer for legal guidance before purchasing or transferring any NFA item.

All NFA item transfers between private parties require ATF Form 4 approval, including a background check, fingerprints, passport-style photograph, and CLEO notification — regardless of whether the item is legal in your state. The Form 4 tax stamp is $0 as of January 1, 2026, but the application process and compliance requirements remain in full effect.
